If you were commenting on a case, it might fall under fair use laws. That's a different issue to creative commons. I tend to avoid claiming 'fair use' on anything except book reviews, but my instinct says, if it's pictures of victims and perpetrators you've used, you're probably OK. But I'm no lawyer.
